END USER LICENSE AGREEMENT
THIS IS A CONTRACT BETWEEN YOU AND SENDI MUTIARA MULTIMEDIA SDN BHD, A
KUALA LUMPUR, MALAYSIAN CORPORATION. BY ACCEPTING THIS AGREEMENT YOU
ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
If you do not agree with the terms and conditions of this Agreement, do not continue with registration process.
1. Tournament Description
The Sendi Mutiara Multimedia Grand National DotA Tournament – short for SGNDT, is an annual DotA tournament currently on its fourth successive year, hosted directly by Sendi Mutiara Multimedia Sdn. Bhd. (SMM), the official licensing holder of Blizzard products in Malaysia. The qualifying-round for SGNDT 2010 kicks-off this 8th May 2010 and will consecutively run through local states in Malaysia in search for the best DotA teams to represent their country. Only those that earned a place in the 1st, 2nd, 3rd, and 4th from each state-qualifier can proceed to the Grand Final hosted in amongst the best hot-spots in Malaysia, where a lucrative total cash prize of RM150, 000 and international contenders await the worthy champions.
2. Rules of Entry
These Official Terms & Conditions relates to the SGNDT 2010 only, and players acknowledge that in addition to these Terms & Conditions, the DotA Rules & Regulations shall apply. In the event of any inconsistency between these Official Terms & Conditions and DotA Rules & Regulations, these Official Rules shall prevail.
3. Eligibility
The SGNDT 2010 is open to Players who are legal residents of Malaysia. Players who are of international status are eligible to participate in the Grand Finals phase. Players who are found to have registered for multiple national/region Tournaments may be disqualified.
2. Registration/Qualifying
Players will be required to register before they compete in SGNDT 2010 on the 8th of May at www.smm.net.my
To register in SGNDT 2010 Players need to:
1) Head over to www.smm.net.my
2) Click “Register my team”
3) Fill in your complete team and member details.
4) A confirmation email will be sent to your mail-box within 3 working days. Included will be tournament details, venue address, time, and number to contact.
5) Print a copy of the document and submit it on the tournament day itself.
6) A payment of RM 120 is to be made directly on the day of the event. Kindly refer to the state scheduling date for the exact day.
Registering to compete in SGNDT 2010 does not guarantee that Players will be eligible to participate in SGNDT 2010. Sendi Mutiara Multimedia reserves the right to verify all eligibility criteria outlined in these Terms & Conditions, even after registration has closed.
Players may only compete using a single Clan Name. If a Player is found to have competed fraudulently under multiple identities or Clan Name, they will not be considered an eligible Player, they will be disqualified from participating in the Tournament and they could be disqualified from participating in future SMM tournaments. Players must ensure that their Registration forms, including e-mail addresses and address/phone, is correct and current as Sendi Mutiara Multimedia will use these details to contact Players.
SGNDT 2010 will comprise two stages:
(i) Stage 1/ SGNDT 2010: State Qualifiers: involves state participation from the following respective states: Negeri Sembilan, Penang, Pahang, Sabah, Sarawak, Johor, Selangor, and Kuala Lumpur. Only those that earned a place in the 1st, 2nd, 3rd, and 4th from each state-qualifier can proceed to the Grand Final hosted at its designated location
(ii) Stage 2/Grand Final: involves the 1st, 2nd, 3rd, and 4th from each state-qualifier and international participants to be slotted into the Grand Final roster to compete for first place.
3. Code of Conduct
Any Player competing in an unsportsmanlike manner or in a manner that is not in compliance with the Official Rules & Regulations set by Sendi Mutiara Multimedia may be immediately disqualified from SGNDT 2010 and may be disqualified from competing in future Sendi Mutiara Multimedia events. Unsportsmanlike conduct includes, but is not limited to, the following violations:
Unsportsmanlike conduct (noise)
Swearing or threats
Spamming or screaming
Harassment
Lewdness
Using any device to create loud sounds
Any other type of conduct deemed inappropriate
Unsportsmanlike conduct (gameplay)
Cheating of any sort through various means
Continuous pauses during the gameplay
Delaying or slowing gameplay using various tactics
Intentionally disconnecting the network cable
Intentionally interrupting network connectivity
Using any type of modified teams
Using any ‘game codes’ or other means of enhancing a players score
Any other known or unknown way of tampering with gameplay
5. Prizes:
(i) The winners from Stage 1: SGNDT 2010: State Qualifiers will receive the following prizes:

1st Runner Up: RM1000 Cash + Medal
(Qualified to National Grand Final)
2nd Runner Up: RM600 Cash + Medal
(Qualified to National Grand Final)
3rd Runner Up: RM 300 Cash
(Qualified to National Grand Final)
(ii) The winners from Stage 2: SGNDT 2010: Grand Final will receive the following prizes:

1st Runner Up: RM 21,000 Cash + Trophy + sponsors product
2nd Runner Up: RM 14,000 Cash + Trophy + sponsors product
3rd Runner Up: RM 9,000 Cash + sponsors product
5th place: RM 3,000 Cash + sponsors product
6th place: RM 2,000 Cash + sponsors product
7th place: RM 1,500 Cash + sponsors product
8th place: RM 1,000 Cash + sponsors product
The prize values are the recommended retail value in Malaysia as provided by the supplier and is correct at the time of printing. Sendi Mutiara Multimedia accepts no responsibility for any variation in the value of a prize. Sendi Mutiara Multimedia and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
The payment of any applicable tax on a prize is the sole responsibility of the winner of a prize. No substitution or transfer of a prize is permitted except at the sole discretion of Sendi Mutiara Multimedia. If a winner cannot or will not accept a prize, the prize will be forfeited. Sendi Mutiara Multimedia reserves the right to substitute a prize of equal or greater value if the entire prize or a portion of the prize is unavailable. If SGNDT 2010 is cancelled for any reason, Sendi Mutiara Multimedia shall have no further obligation to the Players.
6. Conduct
By entering SGNDT 2010, Players agree to be bound by these Rules & Regulations and Rules of Entry referenced in these Official Rules. The Official Rules will be received upon signing up and registering for SGNDT 09’ at www.smm.net.my throughout the Official Sendi Mutiara Multimedia website. Players further agree to be bound by the decisions of Sendi Mutiara Multimedia which shall be final and binding in all respects. Sendi Mutiara Multimedia reserves the right, at its sole discretion, to disqualify an individual it finds to be tampering with the type, process, or operation of the game or Web site, to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person.
CAUTION: ANY ATTEMPT BY A PLAYER OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF SGNDT 09’ MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SENDI MUTIARA MULTIMEDIA RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PLAYER TO THE FULLEST EXTENT PERMITTED BY LAW.
7. Limitations of Liability
Except for any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void (“Non Excludable Condition”), Sendi Mutiara Multimedia excludes from these Official Rules all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, Sendi Mutiara Multimedia (including its officers, employees and agents) exclude all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of SGNDT 09’, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under Sendi Mutiara Multimedia’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by Sendi Mutiara Multimedia) due to any reason beyond Sendi Mutiara Multimedia’s reasonable control; (d) any variation in prize value to that stated in these Official Rules; (e) any tax implications; and/or (f) a prize or use of a prize.
PRODUCTS AND SERVICES THAT MAY BE OFFERED BY THIRD PARTIES (WHO ARE NOT AFFILIATES OF SENDI MUTIARA MULTIMEDIA) IN CONJUNCTION WITH THIS PROMOTION (INCLUDING ANY PRIZES) ARE SUBJECT TO THE TERMS AND CONDITIONS FOR WARRANTY, SERVICE AND MAINTENANCE AS PROVIDED BY THOSE THIRD PARTIES. SENDI MUTIARA MULTIMEDIA ACCEPTS NO RESPONSIBILITY FOR THE SAME AND SUCH PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” “WITH ALL FAULTS” AND “AS AVAILABLE” BASIS.
Sendi Mutiara Multimedia is not responsible for any incorrect or inaccurate information whether caused by website users or by any of the equipment or programming associated with or utilized in this SGNDT or by any technical or human error which may occur in the processing of game plays. Sendi Mutiara Multimedia does not assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access which may result in alteration of game plays or game results. Sendi Mutiara Multimedia is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or registration to be received by Sendi Mutiara Multimedia or Players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including any injury or damage to a Player's or to any other person's computer related to or resulting from participation in the SGNDTs.
Sendi Mutiara Multimedia is not responsible for the inability of any Player to access or complete a game due to any technical malfunction or traffic congestion on the Internet or at any website or combination thereof. Sendi Mutiara Multimedia, in its sole discretion, may require the replaying of any game or round or section, or declare any of the foregoing null and void by reason of any technical or other system error. If for any reason SGNDT is not capable of running as planned, including as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other causes beyond the control of Sendi Mutiara Multimedia which corrupt or affect the administration, security, fairness, integrity, or proper conduct of SGNDT 09’, Sendi Mutiara Multimedia reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the SGNDT. Without limiting the generality of the foregoing, in the event that Sendi Mutiara Multimedia determines, in its sole discretion, that any individual games within SGNDT have been tampered with or that the validity of any games or rounds has been compromised for any reason, it may eliminate that game or round from SGNDT and conduct SGNDT on the basis of the remaining games or rounds.
In the event that any Player is adversely affected in a game or round by any technical or equipment malfunction, Sendi Mutiara Multimedia shall have no obligation to such Players, but reserves the right, in its sole discretion, to schedule special games or rounds among any such Players so adversely affected. In the event of a dispute as to a Player’s identity, a Player’s identity shall be declared to be the authorized account holder of the e-mail address submitted at time of registration. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
8. General Conditions
The conduct of SGNDT and the interpretation and enforcement of these Official Rules is governed by the laws of Malaysia. In the event that any dispute arises against Sendi Mutiara Multimedia regarding SGNDT, Players agree that the dispute shall be resolved in accordance with the laws of Malaysia without regard to conflicts of law provisions and that such disputes shall be resolved within and by the courts of Malaysia. If any provision of these Official Rules shall be declared void or unenforceable, then such provision shall be replaced with terms that most closely match the intent of Sendi Mutiara Multimedia and the remainder of these rules shall continue in full force and effect. Sendi Mutiara Multimedia’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Prizewinners may be required to execute Affidavits of Eligibility, Liability and Publicity Release (where lawful) within two 2 days of winner determination. Non-compliance within this time period may result in disqualification and an alternate winner being selected. Return of prize or prize notification as undeliverable will result in disqualification and selection of an alternate winner in accordance with these Official Rules.
All winners and Players grant to Sendi Mutiara Multimedia the right to publish, online and in print, their Gamer Tag, names, likenesses, city of residence, and the name of the state in which they live, without compensation. Acceptance of a prize constitutes the winner’s permission (and winners agree to confirm this permission in writing) for Sendi Mutiara Multimedia and its parents, divisions, agents, successors and assigns, to use, copyright, reproduce, display and publish in any media, now known or hereafter developed, including the world wide web, their name, address, photograph, or other likeness, voice or biographical data, for promotional and/or advertising purposes without notice or further compensation, unless legally prohibited. Players, by participating, release and agree to hold harmless Sendi Mutiara Multimedia, its respective parents, affiliates, subsidiaries, advertising and promotion agencies and each of their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses or damages of any kind to persons, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in SGNDT or any Stage 1 or any Stage 2 related activities.
Sendi Mutiara Multimedia’s Privacy Policy will apply to SGNDT and to all information that Sendi Mutiara Multimedia receives from Players. Please read the Privacy Policy on SGNDT registration page before accepting the Official Rules and registering for SGNDT. Please note that by participating in SGNDT 09’, Players are also accepting the terms of the Privacy Policy.
Sendi Mutiara Multimedia collects Player’s personal information in order to conduct SGNDT and may, for that purpose, disclose such information to third parties including, but not limited to, prize suppliers and for any purpose required under Malaysian legislation. Participation in SGNDT is conditional upon providing this information. If a Player ‘opts in’ at the time of entry, Sendi Mutiara Multimedia may also use the information for future promotional, marketing or publicity purposes. Players should direct any request to access, update or correct information to Sendi Mutiara Multimedia.
9. Winners List
The names of the Tournament winners will be posted on the Internet at www.smm.net.my within 15 days of the Tournament end date.

All the other product names are registered trademarks of their respective holders.
